These terms and conditions (the "Terms and Conditions") govern the use of trendoscope.au ( the "Site"). The Site is owned and operated by Trendoscope. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property

All content published and made available on our Site is the property of Trendoscope and Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files, open source and paid materials and anything that contributes to the composition of our Site.

Acceptable Use

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

Violate the intellectual property rights of the Site owners or any third party to the Site.

If we believe you are using our Site or the contents illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site and the tradingview algorithms which are sold as part of the Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site

Sale of Goods

These Terms and Conditions govern the sale of digital access available on our Site.

All the goods available in our site are trading algorithms derived from generic information available in the public. These are digital access in nature and available on the Tradingview web platform. These Terms and Conditions apply to all the digital items listed on our Site the time you access it. All information, description or images that we provide about our algorithms are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all information we provide. Algorithms sold on the Site are derived from generic information available in public. The products are made for users who are experts and already know how to apply these products in their trading. Trendoscope neither recommend or guide people on using them. You agree to purchase algorithms from our Site and use them at your own risk.

All the items purchased from the Site are for personal use only. The algorithms should not be used for commercial purpose of any nature and are not allowed to resell or distribute in any other way.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Trial Access

Valid users can avail 7 day free trial for all the listed algorithms to validate the product and to understand the suitability. Trial requests need to be made before making any purchases, no trials will be given on the product once purchase is made. Users need to avail trial by submitting details in contact form. Neither payment nor card details are required for requesting trial access.

User requirements for trial access

In order to avail trial access, users need to meet certain criteria. This condition is introduced to avoid users misusing trial access by creating new user ids every 7 days. Users need to meet either of the below conditions in order to avail trial access

Trading account is at least 6 months old

User has paid tradingview subscription.

Purchases and Subscriptions

You can purchase access for any listed algorithm for available time period on Algorithms Page. Access to requested algorithm or set of algorithm will be provided for specified time. You can also purchase lifetime access to algorithm which will give you right to access the algorithms on tradingview platform.

Recurring monthly subscriptions are available on Recurring Subscriptions Page. Subscriptions run for 11 months and you will in turn get 12 months access including bonus 12th month access. You can cancel subscription any time. If cancelled, access to the algorithm is ceased immediately and you will not receive the bonus month access. Any defaults made are considered as cancelled and will lead to instant cancellation of subscription.

All the access are valid till Tradingview platform is publicly available. Trendoscope is not liable to provide any refunds due to any changes made in Tradingview platform access policies or unavailability of the Tradingview platform or any other reason related to Tradingview.

Our exclusive partnership with Pepperstone grants you up to 6 months of free access to Trendoscope premium algorithms when you open a new Pepperstone account using our referral link and sending us your approved Live Account number as confirmation. Post that, amount of months of free access you receive is based on various factors including your location, initial deposit, trade volume etc. Please note that 74-89 % of retail investor accounts lose money when trading CFDs

This offer may be terminated at any time without notice. Trendoscope does not recommend trading any specific instrument nor it will recommend any investment strategies. Rewards are only based on the the agreement between Pepperstone and Trendoscope partnership programme.

Refunds

No refunds are provided for any purchased items. Users are encouraged to use both free algorithms and trial access to understand the suitability before making any purchase.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislations in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of the legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

In no event will trendoscope be liable for (I) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service. Even if trendoscope or its authorised representatives have been advised of the possibility of such damages, or (ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such states, trendoscope's liability is limited to the greatest extent permitted by law.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Trendoscope and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violations of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of Victoria

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and reflect any changes.
